I don't think this is a property rights issue. The guy sold his rights for a good chunk of consideration via the easement. If he didn't understand what was in the easement agreement, then maybe it's a contract dispute, but not a property rights issue. (I'm assuming he sold this easement of his own volition.)
Being pro-property rights does not mean being anti-business. Posting this as a property rights issue confuses the issue.
